Selling nationally sounds like a straightforward success story until sales tax enters the picture. You're shipping to customers in dozens of states, operating out of one or more fulfillment locations, and navigating a different set of rules in every jurisdiction. What triggers an obligation in Texas isn't the same as what triggers one in Colorado, and the thresholds, filing frequencies, and product taxability rules vary everywhere.

What actually creates nexus for eCommerce sellers
Nexus is the connection between your business and a state that requires you to collect and remit sales tax there. For eCommerce sellers, it comes from more places than most people realize.

Physical nexus comes from having a tangible presence in a state: employees, offices, or inventory stored there. If you use Fulfillment by Amazon, your inventory is sitting in fulfillment centers across the country, potentially in states you've never done business with directly. Each of those locations can create physical nexus.
Economic nexus comes from sales volume alone. Following the 2018 Wayfair ruling, every state with a sales tax has adopted economic nexus thresholds, typically $100,000 in sales or 200 transactions in a state within a calendar year. Cross that line and you have an obligation, regardless of whether you have a single employee or square foot of space there.


Marketplace sales add another layer of complexity. If you sell through Amazon, Etsy, or Walmart Marketplace, those platforms collect and remit tax on marketplace transactions in most states under marketplace facilitator laws. But those marketplace sales still count toward your economic nexus thresholds. Cross a threshold through marketplace volume alone and you may have obligations for your direct-channel sales that no platform is handling for you.


The platform doesn't solve the problem
A common point of false confidence for eCommerce businesses: "we have Shopify handling our tax." Sales tax software and platform plugins do useful things. They calculate rates, apply product taxability rules, and automate filing in states where you're already registered.

What they don't do is tell you where you need to be registered in the first place. That determination requires a human review of your actual footprint, your channels, your products, and your sales by state. Software calculates correctly inside the states you've configured. The configuration itself is a separate problem.
