If you sell into Virginia, you probably enjoy the fact that SaaS is currently tax-free. It's one of the few states where SaaS companies don't have to collect sales tax. However, House Bill 900 proposes taxing digital products and subscriptions starting January 2027.
The quick version: $100,000 in gross sales or 200 transactions triggers nexus. SaaS is exempt for now. Local taxes in NoVA and Hampton Roads add a 0.7% regional surcharge on top of the standard 5.3%.

Most of the state collects the standard 5.3% combined rate. Ship to NoVA or Hampton Roads, and you add a 0.7% regional transportation tax to reach 6%. Use the state's rate lookup tools to confirm whether an address falls within one of those transportation districts.
$100,000 or 200 transactions — register immediately
Virginia requires remote sellers to register once they exceed $100,000 in gross sales or 200 transactions into the state, whether that happens in the current calendar year or the previous one.
- Virginia counts all your revenue toward the $100,000 limit, not just taxable sales.
- Sales through marketplace facilitators like Amazon or Etsy don't count toward your limit — those platforms handle collection for you.
- Once you cross the limit, register before your next transaction. There's no grace period.
SaaS is exempt — for now

Three annual sales tax holidays
Virginia offers three annual sales tax holidays — more than most states. Retailers must participate; the exemption applies automatically at checkout.
Back-to-School Holiday
First weekend in August (Friday–Sunday). School supplies under $20; clothing and footwear under $100; portable generators under $1,000; Energy Star/WaterSense products under $2,500.
Energy Efficiency Holiday
Four days in mid-October (Friday–Monday). Energy Star/WaterSense products under $2,500; portable generators under $1,000.
Emergency Preparedness Holiday
One week in late February or early March. Portable generators under $1,000; emergency supplies like batteries, flashlights, tarps, and first aid kits (most under $60).
Filing and registration
Registration
The Virginia Department of Taxation handles sales tax. Register through Virginia Tax Online or by filing Form R-1 (Combined Registration Application). Registration is free — usually approved within a week, though paper applications take 2–3 weeks.

Not home-rule — and a full SST member

Virginia typically limits lookback to 3 years under a VDA, versus the standard four-year statute of limitations. Penalties are waived entirely — given Virginia hits you with 30% otherwise, that's significant. Interest remains due in full.

Resale certificates
Virginia issues Form ST-10 for resale purchases. Sellers may also accept the Streamlined Sales Tax Uniform Exemption Certificate. Certificates are blanket and don't expire, though you should periodically verify the buyer's registration remains active. Valid certificates need the buyer's business name, Virginia registration number, reason for exemption, and signature.
Seller liability
If you accept a certificate and the state later deems it invalid, Virginia generally shields you from paying the tax out of pocket — as long as the form looks complete and makes sense for the buyer's business.
