Systematic and process-oriented — with real quirks underneath
Pennsylvania might seem like one of the simpler states for sales tax at first glance: a flat 6% rate, no sprawling web of local jurisdictions, and a reputation for being systematic. But dig a little deeper and you'll find some unique quirks that can trip up even experienced businesses.
The quick version: Pennsylvania taxes SaaS and digital goods, exempts most clothing, and has a registration timeline that differs from most other states — you wait until April 1 of the following year.
If you're a remote seller shipping to Philadelphia or Pittsburgh, you only collect the 6% state rate, not the local add-ons that brick-and-mortar businesses pay.
Pennsylvania sales tax rate table
| Field | Value |
|---|---|
| State base rate | 6.0% |
| Average combined rate (state + local) | 6.34% |
| Local add-on range | 0% to 2% |
| Maximum possible combined rate | 8.0% |
| Rates vary by county / city | Yes, but only for in-state businesses |
| Destination-based or origin-based | Destination-based |
Philadelphia adds 2% (reaching 8% total) and Allegheny County adds 1% (reaching 7% total), but remote sellers shipping into these jurisdictions collect only the 6% state rate. Local add-ons apply only to businesses physically located there.
$100,000 — but registration waits until April 1
Remote sellers must collect sales tax once they exceed $100,000 in gross revenue from state sales during the previous calendar year. There's no transaction count threshold.
- Pennsylvania checks this once a year. If you crossed $100,000 in 2025, you're required to register by April 1, 2026. This rule took effect July 1, 2019.
- Sales made through marketplace facilitators like Amazon or Etsy do count toward your threshold — even if the marketplace already collects tax, those sales still count for determining whether you've hit the threshold.
SaaS is taxable — custom software sometimes isn't
Pennsylvania treats most digital products as taxable tangible personal property.
| Product / service | Tax treatment |
|---|---|
| SaaS (B2B and B2C) | Taxable at 6% |
| Downloaded software (permanent license) | Taxable at 6% |
| Streaming / subscription software access | Taxable at 6% |
| Custom software (built for one client, separately stated) | May qualify as exempt |
| E-books, music, video downloads / streaming | Taxable at 6% |
| Digital images & fonts | Taxable at 6% |
| Data processing / information services | Generally exempt |
| Cloud storage / hosting | Depends on features — pure storage exempt; bundled tools taxable |
Bottom line: if it resembles software or a digital product, expect it to be taxable. The DOR hasn't issued extensive formal guidance on cloud services, which creates confusion for bundled packages.
Product taxability in Pennsylvania
| Product category | Tax treatment |
|---|---|
| Groceries & unprepared food | Exempt |
| Prepared food & restaurant meals | Taxable at 6% |
| Candy & soft drinks | Exempt (treated same as groceries) |
| Clothing & apparel | Exempt (most ordinary clothing) |
| Footwear | Exempt (most ordinary footwear) |
| Prescription drugs | Exempt |
| Over-the-counter medications | Exempt |
| Medical devices & durable equipment | Exempt |
| Agricultural inputs | Exempt |
| Manufacturing machinery & equipment | Exempt (direct use) |
| Raw materials used in manufacturing | Exempt |
| Electricity & gas used in production | Exempt (direct manufacturing use) |
| Computers & business equipment | Taxable at 6% |
Clothing exemption: one of the broadest in the US — nearly all ordinary apparel and footwear, no caps or limits. Exception: formal wear, sporting goods, and protective equipment remain taxable.
Pennsylvania does not currently offer any sales tax holidays
The legislature has periodically considered a back-to-school holiday, most recently during 2024 and 2025 budget discussions, but no law has passed. Given Pennsylvania's narrow sales tax base (clothing is already exempt year-round), the fiscal impact has discouraged adoption.
Filing and registration
Registration
The Pennsylvania DOR handles sales tax. Register through the PA-100 Enterprise Registration Form via the myPATH online portal or by paper form. Registration is free and usually takes 2 to 3 weeks for online submissions.
Filing frequencies
| Frequency | Assigned when… |
|---|---|
| Monthly | Tax liability exceeds $25,000 annually |
| Quarterly | Tax liability $600–$25,000 annually |
| Annual | Tax liability under $600 annually |
Returns and payments are due on the 20th of the month following the reporting period.
Large-filer rules
High-volume filers with tax liability exceeding $25,000 per month must make accelerated prepayments — often semi-monthly or weekly, based on prior year's liability.
Penalties and interest
- Late filing: 5% of unpaid tax per month, up to 25%
- Late payment: same structure, 5% per month, maximum 25%
- Interest: adjusts annually, currently 3% above the federal short-term rate
Vendor discount: 1% on timely filed returns, capped at $25 per return.
Not sure which of these apply to you?
We map your Pennsylvania exposure — the April 1 registration timeline, SaaS taxability, clothing exemption edge cases — and tell you exactly what to do next.
Not home-rule — and not an SST member
Pennsylvania is not a home-rule state for sales tax. You register once with the DOR, and that covers your entire statewide obligation. Philadelphia (2%) and Allegheny County (1%) have local add-ons, but remote sellers don't collect these local rates — only businesses with a physical location in those jurisdictions do.
Pennsylvania is not a member of the Streamlined Sales Tax program. You won't benefit from simplified registration or uniform tax rules — one state rate, limited local taxes, and clear nexus rules make it relatively straightforward, but you're handling Pennsylvania's rules independently rather than through a centralized SST framework.
Voluntary Disclosure Agreement (VDA)
Pennsylvania offers a formal VDA program administered directly by the DOR, plus a path through the Multistate Tax Commission (MTC).
Lookback & relief
With a VDA, you only owe for 3 years of back taxes no matter how much you underreported. Penalties are fully waived; interest is not waived.
Eligibility & process
You're ineligible if Pennsylvania has already contacted you. The state requires paper filings and mailed checks — no electronic registration, filing, payment, or signatures during the VDA process, making it slower than most states. Expect 90 to 120 days from application to final agreement.
Practical note: businesses with 3 or more years of unreported PA sales should strongly consider a VDA before registering going forward — especially those with local tax exposure questions in Philadelphia or Pittsburgh.
Audit risk in Pennsylvania
Pennsylvania's DOR frequently cross-references out-of-state purchases and targets specific industries for review. They rely heavily on data matching and strict procedural guidelines rather than handing out massive discretionary penalties.
Common audit triggers
- Use tax gaps on out-of-state equipment purchases
- Manufacturing exemption boundaries — misclassifying production equipment vs. administrative assets
- Digital goods and SaaS classification — businesses treating software as exempt services
- High exempt sale ratios without proper documentation
- Inconsistent filing patterns or large period-to-period swings
Statute of limitations
3 years for standard returns, extending to 6 years if you underreport taxable sales by more than 20%; no limit for fraud or non-filers.
Recent changes & quirky rules
Philadelphia (2%) and Allegheny County (1%) add-ons apply only to businesses physically located there — out-of-state sellers collect only 6%.
But formal wear, sporting goods, and protective equipment are taxable — a definitional minefield during audits.
Custom software built for a single client may be exempt when separately stated — the line between the two creates compliance risk.
Exemptions & resale certificates
Resale certificates
Pennsylvania issues Form REV-1220 as its official resale certificate. The state also accepts the SST Uniform Exemption Certificate. Certificates are blanket and don't expire unless the buyer's license gets revoked.
Seller liability
If you accept a valid certificate in good faith, you're protected. Pennsylvania does not require sellers to verify license status at time of sale.
Common exemptions
- Resale / wholesale — yes, with valid certificate
- Manufacturing — exemption for machinery and equipment that touches or changes the product during production
- Agriculture — farm equipment and supplies exempt
- Nonprofits / religious organizations — must apply for exemption number
- Government — exempt with proper documentation
Pennsylvania offers direct pay permits to qualified large businesses with consistent use tax compliance.
Your next steps for Pennsylvania compliance
Pennsylvania's systematic approach creates real opportunities for businesses willing to get ahead of the curve — but that doesn't mean you can set it and forget it.
- Crossed $100,000 this year? Mark April 1 of next year on your calendar.
- Selling SaaS or digital products? Assume they're taxable until you've confirmed otherwise.
- Operating without collecting tax? The paper-based VDA process takes time — starting now means resolving your exposure before the DOR finds you first.
