Digital-friendly, but watch the Commerce Tax
Nevada might skip the state income tax, but the Silver State still keeps a close eye on business revenue. Since sales tax is how Nevada pays its bills, the Department of Taxation pays close attention to compliance.

$100,000 or 200 transactions
Nevada requires remote sellers to register once they exceed $100,000 in gross revenue or 200 transactions, measured against either the previous or current calendar year.
- Marketplace sales don't count toward your threshold — the facilitator collects directly.
- Register by the first day of the second calendar month following the month you exceeded the threshold.
SaaS and digital goods are exempt — but watch the Commerce Tax
| Product / service | Tax treatment |
|---|---|
| SaaS (B2B and B2C) | Exempt |
| Downloaded software (permanent license) | Exempt |
| Streaming / subscription access | Exempt |
| Digital goods (e-books, music, video) | Exempt |
| Cloud storage / data processing | Exempt |
Nevada's Commerce Tax is a separate gross receipts tax that applies once you exceed $4 million in annual Nevada-sourced revenue — filed separately from sales tax and often missed by out-of-state sellers.
Product taxability in Nevada
| Product category | Tax treatment |
|---|---|
| Groceries & unprepared food | Exempt |
| Prepared food & restaurant meals | Taxable |
| Clothing & apparel | Taxable |
| Prescription drugs | Exempt |
| Manufacturing machinery & equipment | Taxable — no exemption |
| Diapers | Exempt, since January 1, 2025 |
Manufacturing machinery remains taxable — unlike most states, making use tax compliance on out-of-state equipment purchases critical.
Nevada does not offer any sales tax holidays
With no income tax, broad exemption periods are less attractive from a fiscal standpoint.

Not home-rule — a full SST member since 2008
Nevada is not a home-rule state. Nevada is a full SST member, offering centralized registration and certified service providers.
Voluntary Disclosure Agreement (VDA)
Nevada offers a formal VDA program. Lookback typically 3 years (vs. 4-year standard). Penalties waived; interest owed. You cannot apply once Nevada starts an audit — no exceptions.
Audit risk in Nevada
Moderate enforcement. The single most audited issue: use tax on out-of-state equipment purchases. Other triggers: high exempt sale volume, Commerce Tax filing gaps, lodging and Live Entertainment Tax compliance. Statute of limitations: 3 years; indefinite for fraud.
Recent changes & quirky rules
A separate tax on businesses exceeding $4 million in Nevada revenue — filed separately, often missed.
Venues with 200+ capacity add 9% on admissions and merchandise when live entertainment is present.
Exemptions & resale certificates
Nevada accepts its official Resale Certificate plus the SST Uniform Exemption Certificate. Blanket, don't expire. Common exemptions: resale, government, nonprofits, agriculture, medical devices.
