Florida sales tax: what growing businesses need to know

One of the last major states to require remote sellers to collect. SaaS stays exempt, but a $5,000-per-item local surtax cap and three annual tax holidays make Florida's rules genuinely unique.

01 Overview

Late to nexus, unique on everything else

Florida enacted its economic nexus rules in July 2021 — one of the last major states to require remote sellers to collect. A 6% state rate combined with county surtaxes often pushes the total over 7%.

The quick version: $100,000 in taxable sales triggers nexus — exempt items like SaaS don't count. Three sales tax holidays run every year.

Maximum combined rate7.5%

Most counties impose a discretionary sales surtax of 0.5% to 1.5% — but it only applies to the first $5,000 of a single item's purchase price.

03 Economic nexus

$100,000 in taxable sales — no transaction count

You cross Florida's threshold the moment your remote taxable sales reach $100,000, measured over the previous or current calendar year. Exempt items like SaaS don't factor into the total.

  • Marketplace transactions are excluded from your $100,000 calculation.
  • Florida adopted these rules three years after most states — businesses that mapped compliance in 2018-19 often miss this state.
Bottom line: Once you hit $100,000 in taxable sales, secure your registration before processing another transaction.

Since SaaS isn't taxable here, it doesn't count toward the $100,000 nexus threshold either.

08 Home rule & SST

Not home-rule — but not an SST member either

Florida is not a home-rule state — one permit covers the whole state. Florida is not an SST member and shows no interest in joining, so you don't get free filing software or centralized registration.

09 VDA program

Voluntary Disclosure Program

Florida's VDA lookback is limited to 36 months (vs. 48-month standard audit). Penalties fully waived; interest owed in full. Process takes 60-90 days.

10 Audit risk

Audit risk in Florida

Florida uses automated data analysis and industry risk profiling. Common triggers: inconsistent monthly reporting, high volume of exempt sales without documentation (retroactive certificates rejected), high-risk industries (restaurants, gas stations, construction, former commercial landlords). Statute of limitations: 36 months standard, 48 for suspected underreporting.

11 Quirks

Recent changes & quirky rules

Commercial rent tax repealed

Effective October 1, 2025 — Florida no longer taxes commercial lease payments (was 4.5%).

Specific services are taxable

Commercial cleaning, pest control, detective services, and printing are taxed — unusual for a state that doesn't tax services broadly.

12 Exemptions

Exemptions & resale certificates

Florida issues an Annual Resale Certificate (Form DR-13), renewed every 12 months — stricter than most states. Florida accepts the SST Uniform Exemption Certificate. Retroactively obtained certificates are rejected. Common exemptions: resale, manufacturing machinery, agriculture, government.
